These terms govern the sale of the app and website development packages offered through the indigocompany.it website. By placing an order, you confirm that you have read and fully accept them.
1. The provider
indigo company, registered office in Italy .
Email: [email protected]
2. Packages and prices
Package prices are shown publicly on the site, in euros, and are inclusive of VAT where applicable. The price shown at the time the order is placed applies: later changes to the price list do not affect orders already confirmed.
Each package includes the features and limits described on the relevant product page at the time of the order. Features not explicitly included in the chosen package can be requested as additional work, quoted separately before being started.
3. How to place an order
An order can be placed in two ways:
- Free request: no charge is made. Our team gets back to you to confirm the details before starting the work and requesting payment.
- Immediate payment: by credit/debit card (Stripe) or, where available, PayPal or cryptocurrency. Payment is due in full at the time of the order, unless you choose to pay in instalments (see the section «Payment in instalments»); the contract is considered concluded when we receive confirmation of the payment (or of the deposit) from the payment provider, not when the order form is simply submitted.
4. Payment in instalments
For orders of a suitable amount you can choose, when ordering, to split the payment into 2, 3 or 4 instalments, with no interest and no extra cost: the total remains the order total. The plan available depends on the total (already net of any discounts): 2 instalments (50% + 50%) from €500, 3 instalments (40% + 30% + 30%) from €1,500, 4 instalments (30% + 25% + 25% + 20%) from €6,000. The exact amount of each instalment is shown before you pay.
- Deposit. The first instalment is paid when you order and kicks off the project; the contract is considered concluded when we receive confirmation of its payment.
- Later instalments. They are not paid in advance: we request them by email, with a personal payment link, when the work reaches the planned stage (an intermediate delivery — for apps a test version, for websites an online draft — and the final delivery for the balance). They are paid with the same methods as the order, where available.
- Delivery once the balance is received. The source code and final files are handed over, and apps and websites are published or put online for good, only after the balance has been received and confirmed.
- Late payments. If a requested instalment is not paid within 7 days of the request, we may suspend the work until it is paid; delivery times shift accordingly for a period equal to the suspension. Before suspending, we send you reminders.
- Invoice. The invoice for the full amount is issued once, when the work is completed and the payment is fully made. Every payment still receives an email confirmation.
- Withdrawal and refunds. The rules in the section on the right of withdrawal apply; in case of a refund, the instalments already paid are returned according to those rules.
5. Delivery times
The delivery times shown for each package are estimates, not binding deadlines, and start from the moment we receive from you all the materials needed to begin the work (text, images, credentials for any required accounts, and any other content only you can provide) — not from the order or payment date. Delays in providing these materials, or in your responses during the review stages, are reflected proportionally in the final delivery times.
6. Your obligations as a customer
For native app development, you are responsible for owning (or creating) the accounts needed for publishing — an Apple Developer account for iOS, a Google Play Console account for Android — and for granting us the necessary access. We are not responsible for delays caused by these accounts not being available, nor for publication being refused by Apple or Google where this results from those platforms' own editorial policies rather than a defect in work delivered in line with the agreed specifications.
You are responsible for the lawfulness of the content (text, images, trademarks) you provide us to include in the app or website: you warrant that you hold the necessary rights to use it.
7. Revisions
Each package includes a number of revision rounds as shown on the relevant product page, to be requested during development. Revisions beyond those included, or requested after final delivery, are quoted separately before being started.
8. Intellectual property
Once the agreed price has been paid in full, the source code developed specifically for your project becomes your property. This transfer does not include any third-party components, open-source libraries, or internal development tools we use as a working foundation, which remain subject to their own original licenses.
9. Right of withdrawal
If you are a consumer, consumer protection law normally grants you a 14-day right of withdrawal from online purchases. This right does not apply to personalized services built to your specifications, such as custom app or website development, once execution has begun with your explicit agreement (in line with the customized-goods-and-services exception found in EU consumer rights law). By placing an order on this site, and explicitly asking us to begin the work, you acknowledge this exclusion.
If you chose the free request and have not yet confirmed that you want to proceed, no payment is due and no work is started: this section applies from the moment you confirm you want to proceed and payment is processed.
10. Warranty and bug fixes
If, within 30 days of delivery, the app or website does not work as agreed in the specifications of the purchased package, we will fix the malfunction at no additional cost. This warranty does not cover requests for new features, aesthetic changes not agreed upon originally, or issues arising from changes made by third parties after delivery.
11. Limitation of liability
To the extent permitted by applicable law, our overall liability for any damage arising from the contract is limited to the amount actually paid for the purchased package. We are not liable for indirect damages, loss of profit, or data loss not directly caused by our failure to perform.
12. Governing law and jurisdiction
These terms are governed by Italian law. For any dispute, if you are a consumer, the court of your place of residence or domicile has jurisdiction.
13. Changes to these terms
We may update these terms from time to time. The version in force at the time you place your order always applies, not later versions. The date of the most recent update is always shown at the top of this page.
